Notice is hereby given in accordance with Regulation 5 and 10 of the Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 that reports containing Key and Exempt information will be considered by Cabinet, at its meeting on Thursday 02 March 2023. Notification of this Key and Exempt Decision was not published on the Council’s website 28 clear days before it was due to be considered by Cabinet, as is required by these regulations.

 

Purpose of the Report

 

Compulsory Purchase Order of a property

 

           Action can now be taken for the Compulsory of a long standing empty property so that it can be brought back into use. Doing so will contribute to the wellbeing of the local community by ensuring that it is now properly maintained and by increasing the supply of available accommodation in the District. Cabinet will be asked to agree that the order now be made under section 17 of the Housing Act 1985. This will enable the refurbishment of the property to take place.

 

 

Reason for urgency:

 

           Work to enable the Compulsory Purchase Order to be made has been in progress for some time. However, it only became possible to now take the necessary action recently. Once this became clear notice was included on the Council’s Forward Plan of Executive Decisions. However this period was not for the 28 clear days required by law.

 

Compliance with the requirement to give 28 clear days’ notice in accordance with the above Regulation is impracticable as the matter is urgent and cannot reasonably be deferred.

 

The issue is causing significant numbers of resident complaints. If the Decision was delayed until the scheduled April Cabinet before action was taken then the situation would become worse.

 

 

 

This report is exempt and it is proposed that it be considered in private to avoid the disclosure of exempt information as defined in paragraphs 3 and 5 of Part 1 of Schedule 12A to the Local Government Act 1972 (as amended by the Local Government (Access to Information) (Variation) Order 2006).

 

The Chair of the Growth Scrutiny Committee has been informed of the Key Decision to be taken in respect of the exempt reports at the above meeting of Cabinet.
