The Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012

 

 

Notice is hereby given in accordance with Regulation 5 and 10 of the Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 that reports containing Key and Exempt information will be considered by Cabinet, at its meeting on Thursday 22 December 2022. Notification of this Key and Exempt Decision was not published on the Council’s website 28 clear days before it was due to be considered by Cabinet, as is required by these regulations.

 

Purpose of the Report

 

Sharley Park Development

 

             There is a strong likelihood that the Council will receive more grant funding support for Sharley Park Redevelopment than anticipated in the business case and previous Cabinet report. The report is to enable the Council to decide how to utilise this additional funding. This amount is greater than the financial thresholds for Key Decisions set by Council.

 

 

Reason for urgency:

 

             The Council was only made aware of the likelihood of additional funding on the 6th December. A decision needs to be taking before the end of December to reduce exposure to costly contract variations in future with a decision required prior to signing the construction contract before the end of December. 

 

Compliance with the requirement to give 28 clear days’ notice in accordance with the above Regulation is impracticable as the matter is urgent and cannot reasonably be deferred.

The timing of the decision cannot be delayed due to the deadlines imposed by the funding application process.

 

This report is exempt and it is proposed that it be considered in private to avoid the disclosure of exempt information as defined in paragraphs 3 of Part 1 of Schedule 12A to the Local Government Act 1972 (as amended by the Local Government (Access to Information) (Variation) Order 2006).

 

The Chair of the Growth Scrutiny Committee has been informed of the Key Decision to be taken in respect of the exempt reports at the above meeting of Cabinet.
