Decision:

To allow for a deed of variation to be agreed to the section 106 agreement in respect of application NED/15/00153/OL for the provision of £44,000 to be made towards the creation of an additional football pitch instead of being used to provide for off-site children’s play equipment as originally required.

Reasons for the decision:

An approach has been received from the developer, the Parish Council and local Ward Members seeking to re-allocate monies in the section 106 agreement attached to planning application NED/15/00153/FL towards the creation of a new football pitch instead of towards providing for off-site children’s play equipment.

The Parish Council indicate that there is no requirement currently for additional children’s play equipment in the village.

It is considered that the aims and objectives of the originally concluded agreement can be achieved by the provision of a football pitch and there is local support for this.

Alternative options considered:

The other option would be to require the delivery of the off-site play equipment as originally envisaged.

However, there is no evidenced need for that provision currently and there is local support to re-divert the money as proposed. The support for this includes the developer.

There appears no planning purpose to be served by requiring the section 106 to be implemented as originally envisaged.
