INCREASE OF LAND CHARGES SEARCH FEES FOR 2025/2026

Decision:

To increase fees for the parts of the Land Charges Search as outlined below and in line with increases by Derbyshire County Council. This will start from the 1st April 2025.

Reasons for the decision:

To increase the land charges fees in line with increased costs from DCC for con 29 consultations. The increased fee for a standard residential search is to increase from £145.00 to £169.00 and £193.00 for commercial searches. Also we are keeping the residential costs the same for a residential LLC 1 at £25.00 and the commercial LLC1 will be set at £45.00.

The increased fee for the Con 29 is to provide additional funding for the TLC Land Charges software package and extra funding for the Land Charges officer temporary posts. These are already improving the service whilst allowing the service to remain competitive in an open market. This increase also covers the increase in fees charged by DCC to cover the highways additional questions. DCC Highways has increased their charges by 3.5% which will be covered in this increase.

Land Charges will charge £15.00 plus vat for each additional question and £20.00 for each parcel of land for both residential and commercial searches

Alternative options considered:

Not to increase the LLC1 fee for residential properties. Not to increase the fee for a standard search was rejected as costs are increasing for the DCC contribution to the search which the Council needs to pass on to the customer. In addition, the service needs to move from a paper based service to an electronic one and this increase will help with the purchase of the TLC Land Charges software and the migration of the LLC register to HMLR.
