The Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012

 

 

Notice is hereby given in accordance with Regulation 5 and 10 of the Local Authorities (Executive Arrangements) (Meetings and Access to Information) (England) Regulations 2012 that reports containing exempt information about Delegated Decisions will be considered by Cabinet, at its meeting on Thursday 29 July 2021. Notification of these exempt Key Decisions was not published on the Council’s website 28 clear days before they were due to be considered by Cabinet, as is required by these regulations.

 

Purpose of the Reports

 

For Cabinet to endorse Delegated Decisions DD/039/21/KA and DD/040/21/KA taken by the Director of Corporate Resources and Head of the Paid Service. The details of these decisions are set out in reports at Item 10 (DD/039/21/KA) and Item 11 (DD/040/21) on the Cabinet agenda for its meeting on 29 July 2021. Decision DD/039/21/KA involved the purchase of new build properties at Alderman Park, Hasland. Decision DD/40/21/KA involved increased costs now associated with the development of new properties at Pine View, Danesmoor.

 

Compliance with the requirement to give 28 clear days’ notice in accordance with the above Regulation is impracticable as the matters are urgent and cannot reasonably be deferred.

 

Reason for urgency: The Decisions were taken to enable required progress to be made in advance of the Cabinet meeting. The relevant Cabinet Members were consulted about the decision and the reasons why progress needed to be made.

 

The reports at Item 10 and 11 on the Cabinet Agenda are exempt and it is proposed that they be considered in private to avoid the disclosure of exempt information as defined in paragraph 3 of Part 1 of Schedule 12A to the Local Government Act 1972 (as amended by the Local Government (Access to information) (Variation) Order 2006).

 

The Chair of the Growth Scrutiny Committee has been informed of the Key Decision to be taken in respect of the exempt report and has consented to consideration of the report being held in private at the above meeting of Cabinet.
